Terms of service
HIPS International — Terms of Service
Last updated: October 21, 2026
1. Introduction
These Terms of Service govern your use of https://hipsinternational.com/ and purchases made through HIPS International (“HIPS,” “we,” “our,” or “us”).
HIPS International offers LGBTQ+ inclusive tourism, destination experiences, events, excursions, and related services in The Bahamas.
Customers purchase and pay for bookings directly through HIPS. Depending on the experience, HIPS may deliver the service itself or arrange for an independent third-party provider to deliver it.
By using our website or completing a booking, you agree to these Terms, our Refund & Cancellation Policy, our Privacy Policy, and any additional conditions clearly presented for your particular purchase.
Nothing in these Terms limits any consumer rights that cannot legally be excluded.
2. Services and Provider Responsibilities
Experiences offered through HIPS may be organized and delivered by HIPS or by independent third-party operators, venues, excursion providers, transportation companies, and event organizers.
The relevant listing or booking confirmation should identify the provider or explain the delivery arrangement where appropriate.
For HIPS-operated experiences, HIPS is responsible for the services it has agreed to provide.
For third-party experiences, the independent provider is responsible for performing the operational duties within its control, including delivering the activity and complying with applicable safety requirements.
HIPS remains the customer's point of contact for bookings and payments made through our website. HIPS will administer customer service, cancellation requests, and refund requests in accordance with the applicable booking conditions and law.
The involvement of a third-party provider does not automatically remove HIPS's obligations to customers who purchased directly from HIPS.
3. Bookings and Confirmation
A booking request is not confirmed until HIPS issues an order or booking confirmation in accordance with the applicable checkout process.
Before completing a purchase, review the experience description, inclusions, date, time, meeting location, participant requirements, total price, applicable taxes, and any additional conditions.
You are responsible for providing accurate contact and booking information.
Please contact HIPS promptly if you identify an error in your booking confirmation.
Changes to confirmed bookings are subject to availability, the applicable booking conditions, and any charges disclosed before the change is accepted.
4. Prices and Payments
Payments for purchases made through our website are collected directly by HIPS using the payment methods offered at checkout.
Prices, currencies, taxes, and additional charges will be displayed or communicated before purchase.
Any deposit, installment arrangement, balance-due date, or additional fee must be disclosed before the customer agrees to the transaction.
Deposit terms remain to be confirmed by HIPS. Until those terms are established, HIPS must not describe deposits as automatically non-refundable or impose an undisclosed deposit charge.
Customers must use an authorized payment method and provide accurate billing information.
5. Customer Cancellations
Customers must submit cancellation requests to HIPS using the contact details provided on our website.
The standard customer cancellation notice period is at least 72 hours before the scheduled start of the experience, subject to the final booking conditions and applicable law.
The applicable Refund & Cancellation Policy explains how the timing of a cancellation affects refund eligibility.
Some experiences may require additional or different conditions because of provider requirements, advance commitments, or the nature of the service. Any such conditions must be clearly disclosed before purchase and reviewed for legal compliance.
The 72-hour rule does not remove any cancellation or refund right provided by applicable law.
6. Cancellations by HIPS or a Third-Party Provider
If HIPS or an independent provider cancels an experience, HIPS will contact affected customers and explain the available options.
Where an experience cannot proceed, HIPS will generally seek to arrange a suitable alternative date first, subject to availability and the customer's agreement.
If rescheduling is unavailable or unsuitable, HIPS will explain the other available remedies in accordance with the booking terms and applicable law.
Nothing in this section requires a customer to accept a replacement experience or removes a right to a refund where one is legally required.
7. Weather and Unforeseen Circumstances
Experiences may be affected by severe weather, sea conditions, transportation disruptions, emergencies, government restrictions, safety concerns, or other circumstances beyond reasonable control.
Where an experience cannot safely or reasonably proceed, HIPS or the responsible provider may cancel, postpone, or modify the activity.
HIPS will communicate material disruptions as soon as reasonably practicable. Rescheduling will generally be explored first, subject to availability and the customer's agreement.
Where rescheduling is unavailable or declined, any refund or other remedy will be determined under the applicable booking terms and law.
A weather disruption does not automatically make a booking non-refundable.
8. Late Arrivals and No-Shows
Customers are responsible for arriving at the designated meeting location at the time stated in their confirmation.
Failure to attend, or arriving too late to participate, may result in loss of the opportunity to participate where the experience cannot reasonably accommodate the delay.
HIPS's proposed standard rule is that customer no-shows are not eligible for a refund, provided the restriction was clearly disclosed before purchase and is lawful in the circumstances.
This restriction does not apply where a refund or other remedy is required by applicable law or where the failure to provide the service is attributable to HIPS or the relevant provider.
Any additional late-arrival charges or penalties must be disclosed before purchase.
9. Safety and Participant Responsibilities
Customers must follow reasonable safety instructions, comply with applicable laws, and respect other participants, personnel, venues, and local communities.
Certain experiences may have age, mobility, swimming, health, equipment, or other participation requirements. Material requirements should be disclosed before booking.
Customers should review the nature of an activity and consider whether it is appropriate for them.
Separate activity-specific waivers or acknowledgments may apply. Such documents cannot remove rights or liabilities that cannot lawfully be waived.
10. Independent Providers
Independent providers may have operational rules concerning meeting arrangements, participant requirements, equipment, and safety procedures.
HIPS will communicate relevant requirements where known and material to the purchase.
A provider's separate terms may govern aspects of operational delivery, but they do not automatically override the customer's purchase agreement with HIPS or mandatory consumer rights.
Customers should contact HIPS about payments, booking administration, and refund requests for purchases made through our website.
11. Inclusive and Respectful Conduct
HIPS is committed to promoting respectful and inclusive experiences for LGBTQ+ travelers and the wider community.
Harassment, threats, violence, unlawful discrimination, or conduct creating a genuine safety risk may result in removal from an activity or refusal of further participation where lawful and appropriate.
Any resulting refund decision will be made under the applicable booking conditions and law.
Customers are not required to disclose their sexual orientation or gender identity simply to browse the website or submit a general inquiry.
12. Intellectual Property
Unless otherwise indicated, HIPS branding, logos, written content, graphics, and other materials owned by or licensed to HIPS are protected by applicable intellectual property laws.
You may use the website for lawful personal purposes. You may not reproduce, distribute, modify, or commercially exploit HIPS materials without authorization, except where permitted by law.
Third-party trademarks and content remain the property of their respective owners.
13. Privacy
Personal information collected through our website and booking process will be handled in accordance with our Privacy Policy and applicable law.
Booking information may be used to process payments, confirm reservations, coordinate experiences, communicate changes, and administer customer service and refunds.
Where necessary to fulfil a booking, relevant information may be shared with the responsible provider, subject to our Privacy Policy and applicable legal requirements.
14. Website Accuracy and Availability
We make reasonable efforts to keep website information accurate. However, prices, schedules, availability, and service details may change, and technical errors or interruptions may occur.
If an error materially affects a purchase, HIPS will contact the customer and seek an appropriate resolution under the booking terms and applicable law.
We may update website content and discontinue listings, subject to our obligations concerning existing confirmed bookings.
15. Liability
HIPS remains responsible for its own contractual obligations and duties imposed by applicable law.
The responsibilities of an independent provider depend on the services it delivers, the relevant agreements, and applicable law.
Any limitation of liability under these Terms applies only to the extent permitted by law. Nothing excludes or limits liability for fraud, negligence, personal injury, or other matters where such exclusion or limitation is prohibited.
16. Changes to These Terms
We may update these Terms to reflect changes to our business, services, or legal obligations.
The current version will be published on our website with an updated date. For existing bookings, the applicable terms will be determined by the agreement made at purchase, subject to lawful changes and mandatory legal rights.
17. Governing Law and Disputes
Proposed governing law: The Commonwealth of The Bahamas, subject to legal review.
HIPS intends to use Bahamian law as the governing law for these Terms where legally appropriate. The enforceability of this clause, the appropriate forum for disputes, and the effect of mandatory consumer protection laws in customers' home jurisdictions must be confirmed by qualified legal counsel before publication.
Customers are encouraged to contact HIPS first to attempt to resolve any concerns constructively.
Nothing in this section prevents a customer from exercising a right to seek a remedy before a court or regulator with appropriate jurisdiction.
